TIMELINE: Land Purchased for Derrick Hale – 2009 to Present

Owner: Derrick Hale (Lot‑2, Montgomery, MA)

 

2009

  • Carl purchases Lot‑2 in Montgomery, MA with a $17,000 cash deposit
     
  • Early signs of wetland manipulation are observed on adjacent lots as Driveway is installed through Wetland 3 to 4 feet high


  • Cease-and-desist order issued only to Carl — no action against others
     
  • Attorney refuses to return deposit despite environmental concerns
     

2010

  • Septic perk test approved — later reclassified as “wetland”
     
  • Neighbor begins altering land and redirecting natural water flow
     
  • Wetland fill begins without any formal studies or permits
     

2011

  • Carl records a certified wetland after relocating it based on DEP & Fish and Game guidance
     
  • A second “replacement wetland” appears, now crowding Lot‑2 as all wetland on Lot - 3 is filled in.
     

2018

  • Conservation orders new flagging, Carl’s land has "issues"; Carl's suggested to hire Levesque Associates.
  • Levesque Associates issue Cease-and-desist order, issued only to Carl — no action against others.
  • Levesque lays out a third wetland, ignoring Carl's previously recorded, (certified wetland) already on record.
  • Evidence shows Levesque supporting the opposing party’s development plan, Carl's disapproval submitted to DEP Springfield
  • Derrick with 3rd build attempt, held up 18 months without permission to build, finally buys a home in Abington, Massachusetts
  • Carls told he can build by DEP but the Developer won't acknowledge and give written permission
     

2020–2023

  • Letters and documentation for formal investigation sent to the Commissioner DEP Worcester, Natural Heritage, Maura Healey, Senator Velis, MA Attorney General's office, last Mark Sanborn NE - EPA
     
  • No formal investigation; no enforcement actions taken
     
  • Extensive photo evidence, dated documents, and professional input all ignored by all departments
     

2024–2025

  • Website built - launched to publicly share evidence and document wrongdoing
     
  • Formal appeal made to federal agencies requesting immediate investigation
     
  • Lot‑2 remains undevelopable due to falsified wetlands and lack of enforcement.


  For over 15 years, one family’s future has been held hostage by improper environmental practices, legal manipulation, and inaction from authorities. The time for investigation and correction is long overdue.
